Terms of Service

These Terms govern your use of the Orpheum software (“the App”) and the orpheum.tv website (“the Site”), together called “the Service.” By installing or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What Orpheum is

Orpheum is self-hosted software for finding, organizing, managing and playing a personal media library on hardware you control. Orpheum does not host, provide, sell or distribute any movies, shows, books or other media, and does not include access to any content source.

2. Your responsibilities

• You are solely responsible for the content you add to, store, stream or share with the App. You must make sure you have the legal right to it under the laws that apply to you, including copyright law.
• You must follow the terms of every third-party service you connect to the App, including metadata APIs and Google.
• You are responsible for securing the computer and network the App runs on, and for who can access your install.
• You must not use the Service to break the law, to infringe anyone's rights, or to interfere with or overload other people's systems.

3. License

As long as you follow these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App for your own non-commercial use. You may not resell the App or remove its notices. Open-source components included with the App are covered by their own licenses, and those licenses win if they conflict with this one.

4. Beta software

Orpheum is under active development and may be offered as a beta. Features may change, break or be removed without notice. Keep your own backups of anything important.

5. Accounts and third-party sign-in

If you turn on accounts, sign-in uses third-party providers such as Google, and their own terms apply. How Orpheum handles that data is described in our Privacy Policy.

6. Intellectual property

The Orpheum name, logo, artwork and the Site's content belong to Orpheum and its licensors. These Terms do not give you any right to use them, other than to refer to the Service accurately.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DATA WILL NOT BE LOST.

8. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, ORPHEUM AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. THEY WILL ALSO NOT BE LIABLE FOR ANY LOSS OF DATA, PROFITS, OR ACCESS TO THIRD-PARTY ACCOUNTS ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE PREVIOUS 12 MONTHS OR US $10.

9. Indemnity

You agree to defend and hold harmless Orpheum and its contributors against claims arising from content you use with the Service, or from your breach of these Terms or of any third party's terms.

10. Termination

You can stop using the Service at any time by uninstalling it. If you breach these Terms, your license ends automatically.

11. Changes

We may update these Terms. When we do, we will change the “Last updated” date above. If you keep using the Service after a change, you accept the updated Terms.

12. General

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms are the entire agreement between you and Orpheum about the Service.
